Yep, we are in the litigation phase of the net neutrality debate. It’s a phase that is expected to last through human history, past the extinction, and into the period where giant bees become the dominant species on earth.

Yesterday, the Court of Appeals in D.C. tossed out lawsuits filed by Verizon and Metro PCS that challenged the FCC’s net neutrality rules. The court said that the plaintiffs needed to at least wait until the rules were published in the federal register. So the ruling just delays the suits until later when at least Verizon is expected to re-file. Meanwhile, the Wall Street Journal says House Republicans are expected to pass a bill overturning the FCC rules. Its future in the Senate is murky but President Obama said he would absolutely veto any such measure.
